These Terms of Service ("Terms") govern your use of Mekanik ("we", "us", "our"), an AI-powered service manual search tool operated by Mekanik. By creating an account or using our service, you agree to these Terms.

1. What Mekanik Does

Mekanik is a search tool. You upload your own service manual PDF files. Our AI indexes the content and lets you search it using natural language. We do not provide, sell, distribute, or host service manuals for download. We are a tool for searching documents you already own.

2. Your Account

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating your account. You must be at least 18 years old to use Mekanik.

3. User-Uploaded Content

You are solely responsible for the content you upload to Mekanik. By uploading a document, you represent and warrant that:

You own or have a valid license to use the document (e.g., you purchased the service manual)
Your use of the document with Mekanik does not violate any applicable law or third-party rights
You will not upload content that is illegal, infringing, or that you do not have the right to use

Mekanik does not review, verify, or endorse any user-uploaded content. We act solely as a tool for indexing and searching documents you provide.

4. Copyright and Intellectual Property

Mekanik respects the intellectual property rights of others. We operate as a service provider under applicable safe harbor provisions.

No redistribution: Your uploaded manuals are private to your shop. They are not shared with, accessible to, or distributed to any other user or third party.
No public hosting: We do not make uploaded content publicly available or downloadable.
Isolated storage: Each shop's documents are stored separately and only accessible by authorized users of that shop (including via the shop's QR code).

5. DMCA / Copyright Takedown

If you are a copyright holder and believe that content hosted on Mekanik infringes your rights, please contact us at mekanikaisupport@gmail.com with the following information:

Identification of the copyrighted work
Identification of the infringing material on our service
Your contact information
A statement of good faith belief that the use is not authorized
A statement under penalty of perjury that the information is accurate
Your physical or electronic signature

We will respond to valid takedown requests promptly and remove or disable access to the material in question.

6. Acceptable Use

You agree not to:

Use Mekanik to distribute, share, or resell copyrighted materials
Upload content you do not own or have a license to use
Attempt to extract, scrape, or bulk-download indexed content
Use the service for any illegal purpose
Attempt to access another user's data or account
Reverse-engineer, decompile, or tamper with our software

7. AI-Generated Responses

Mekanik's AI answers are for informational reference only. While we strive for accuracy, AI-generated responses may contain errors. Always verify critical specifications (torque values, fluid capacities, safety procedures) against the original manual page, which Mekanik provides a direct link to. We are not liable for any damage, injury, or loss resulting from reliance on AI-generated answers.

8. Manual Translation Service

Mekanik offers an optional paid translation service that translates the text content of your uploaded manuals into another language. By using this feature, you confirm that you have the right to translate the document for your own use. Translated content is private to your shop and is not shared or distributed. Translations are generated by third-party machine translation services and may contain errors — always verify critical information against the original document. We are not liable for inaccuracies in translated content.

9. Subscriptions and Billing

Mekanik is offered on a subscription basis (monthly or annual)
Prices are listed on our website and may change with 30 days notice
You may cancel your subscription at any time; access continues until the end of the billing period
Refunds are not provided for partial billing periods
If payment fails, we may suspend access until payment is resolved

9. Data and Privacy

Your use of Mekanik is also governed by our Privacy Policy. Your uploaded documents are stored securely and are not shared with third parties.

10. Service Availability

We aim to provide reliable service but do not guarantee 100% uptime. We may perform maintenance, updates, or experience outages. We are not liable for any losses due to service interruptions.

11. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time. Upon termination, your uploaded documents and data will be deleted within 30 days.

12. Limitation of Liability

To the maximum extent permitted by law, Mekanik and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities. Our total liability shall not exceed the amount you paid for the service in the 12 months preceding the claim.

13. Disclaimer of Warranties

Mekanik is provided "as is" and "as available" without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, or non-infringement.

14. Governing Law

These Terms are governed by the laws of the Province of Quebec, Canada. Any disputes shall be resolved in the courts of Montreal, Quebec.

15. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification. Continued use after changes constitutes acceptance.
